The Federal High Court in Abuja on Tuesday dismissed a new suit filed by Senator Samuel Anyanwu after he applied to withdraw the case. The matter was struck out following his decision not to continue with the legal action.
At the hearing, Anyanwu’s lawyer informed the court that developments surrounding the case had made it unnecessary to proceed further. He explained that continuing with the suit would waste the court’s time and therefore asked that it be withdrawn.
The dispute is linked to the office of the PDP National Secretary. The crisis started when Anyanwu left the position to contest the 2023 Imo State governorship election, which he later lost. His attempt to return to the office after the election led to divisions within the party, as Sunday Udeh-Okoye also claimed the position.
In December 2024, the Court of Appeal in Enugu upheld an earlier judgment that removed Anyanwu and recognised Udeh-Okoye as the party’s National Secretary. Anyanwu challenged the ruling at the Supreme Court and asked for a pause in its execution.
In March 2025, the Supreme Court overturned the earlier judgments and restored Anyanwu’s position. Despite this decision, disagreements over leadership at the PDP national secretariat continued, with different groups asserting control.
To clear the uncertainty, Anyanwu later filed a fresh suit at the Federal High Court in Abuja, asking the court to enforce his position and grant related requests. In November 2025, the court allowed changes to his case and set a hearing date for January 20, 2026, while also awarding costs against him.
When the case came up for hearing, Anyanwu chose to withdraw it. Lawyers representing other parties asked the court to dismiss the suit and requested costs, arguing that the case should not have been filed.
In response, Anyanwu’s lawyer said the withdrawal was due to circumstances beyond his client’s control and asked the court not to impose any financial penalties.
After listening to all sides, the presiding judge dismissed the suit and refused all requests for costs. The court ruled that the delay was not caused by any party and ordered that each side should bear its own expenses.
