The Federal High Court sitting in Ado Ekiti has cancelled the governorship primary election conducted by the Peoples Democratic Party in Ekiti State on November 8, 2025. The decision followed a legal action filed by one of the party’s aspirants, Funso Ayeni, who challenged the process used to select the party’s candidate.
In his ruling, Justice Babs Kuewumi held that the primary election did not comply with the provisions of the law and the party’s constitution. The court found that the party failed to present a valid and complete list of statutory and ad hoc delegates who took part in the exercise. Based on this, the judge declared the primary invalid and ordered the PDP to conduct a fresh election.
The court also directed that the new primary should be organised in collaboration with the Independent National Electoral Commission and conducted strictly in line with legal and party guidelines. It further stated that all qualified aspirants must be allowed to take part in the rerun.
Dr Wole Oluyede, who emerged as the winner of the cancelled primary, has reacted by indicating his intention to challenge the judgment. Through his lawyer, he disclosed plans to file an appeal and seek a stay of execution of the court’s order.
Oluyede had earlier been left out of the list of governorship candidates released by INEC for the Ekiti governorship election scheduled for June 20, 2026. He has maintained that he will pursue all available legal options to ensure his name is restored and that he remains in the race.
The judgment has added a new twist to the PDP’s preparations for the Ekiti governorship election, as the party now faces the task of organising a fresh primary under close legal scrutiny.
