A Federal High Court in Ado Ekiti on Tuesday ruled on who, what, when, where, why, and how the Peoples Democratic Party governorship primary for the 2026 Ekiti election should be handled, as it cancelled the exercise that produced Wole Oluyede as candidate and ordered a fresh poll.
The court acted after Funsho Ayeni, an aspirant in the race, approached it to challenge the primary. He argued that the party failed to present the original list of statutory and ad hoc delegates who took part in the exercise. The case was heard in Ado Ekiti and decided on January 13, 2026.
In its decision, the court held that the absence of an authentic delegates list violated the Electoral Act and the PDP’s own rules. The judge found that this failure made the entire primary process invalid under the law.
Justice Babs Kuewumi directed the PDP to conduct a new governorship primary in collaboration with the Independent National Electoral Commission. The court also ordered that the fresh exercise must follow all legal and party guidelines and allow every qualified aspirant to participate.
The ruling has reopened the Ekiti governorship contest ahead of the 2026 election, placing the responsibility on the PDP to organise a fresh and lawful primary process.
