The Federal High Court in Abuja on Tuesday struck out an ex-parte motion filed by Nnamdi Kanu seeking his transfer from the Sokoto correctional facility to another prison.
The case came up before Justice James Kolawole Omotosho, where Kanu’s counsel, Demdoo Asan of the Legal Aid Council, informed the court of his decision to withdraw from the matter. He explained that issues had arisen between him and the applicant that made it impossible to continue representation.
Asan told the court that he had been in constant contact with Kanu’s relatives since the last adjournment, but they failed to visit his office to swear to the application. He also stated that Kanu attempted to control how the case would be handled in court, a situation he said was against his duty as a legal officer.
After consulting with his superiors at the Legal Aid Council, Asan said the agency agreed that legal counsel must be allowed to handle cases independently. He then applied to withdraw under the relevant provisions of the court rules.
In his ruling, Justice Omotosho approved the request and allowed the Legal Aid Council to step down from the case. He also ruled that the ex-parte motion was defective.
The judge noted that the court had earlier directed that other parties involved should be properly served. However, from December 8, 2025, to January 27, 2026, there was no evidence before the court showing that service had been carried out.
Based on these findings, the court struck out the motion for lack of competence.
